Welcome to UAGS. This website is operated by UAG Services Pty Ltd (ABN 20 508 692 637), located at Gate 2, 7 Royan Place, Bayswater North VIC 3153, Australia.

These Terms of Service apply when you access or use our website, place an order, create an account, request a quote, purchase products or interact with UAGS online.

Unless stated otherwise, pricing on this website is displayed excluding GST, with GST added at checkout where applicable.

By using this website or purchasing from UAGS, you agree to these Terms of Service, together with any other policies referenced on our website, including our Returns Policy, Shipping Policy, Warranty Policy and Privacy Policy. If you do not agree with these terms, you should not use this website or place an order with us.

1. About UAGS

UAGS supplies traffic control equipment, temporary traffic management products, vehicle warning systems, vehicle fitout components, safety equipment, signs, electrical components and related trade products.

Our products are commonly purchased by traffic control companies, civil contractors, utilities, councils, fleet operators, installers, businesses and trade customers. Some products may also be purchased by individual customers.

2. Website use

You agree to use this website lawfully and responsibly. You must not use this website in a way that may damage, interrupt, overload or interfere with the website, our systems, our customers, our staff or any third party.

You must not use this website to upload malicious code, scrape content, copy product data without permission, impersonate another person, submit false information, attempt unauthorised access, or use the website for any unlawful purpose.

We may restrict, suspend or block access to the website if we reasonably believe the website is being misused.

3. Accounts and customer information

You may be asked to provide information such as your name, business name, billing details, delivery address, email address, phone number and payment information.

You are responsible for ensuring that all information you provide is accurate, current and complete. UAGS is not responsible for delays, delivery issues or order errors caused by incorrect or incomplete information supplied by the customer.

If you create an account, you are responsible for keeping your login details secure and for all activity that occurs under your account.

4. Product information

We aim to provide accurate product descriptions, images, specifications, pricing and availability information. However, errors, omissions or changes may occur.

Product colours, finishes, packaging, labels, appearance and minor details may vary from images shown on the website due to screen settings, supplier changes, production batches or product updates.

Product specifications, availability and pricing may be changed or corrected at any time without notice. We may update, discontinue or replace products at our discretion.

5. Product suitability

Customers are responsible for checking that a product is suitable for their intended use before purchase, installation or deployment.

Suitability may depend on the project, traffic management plan, traffic guidance scheme, vehicle setup, electrical system, installation method, operating environment, road authority requirements, workplace procedures, site conditions or intended application.

Some products may require competent installation, qualified fitting, correct electrical protection, manufacturer instructions, project-specific assessment or use by trained personnel.

UAGS may provide general product information, but we do not provide engineering, electrical, legal, road authority, compliance or traffic management design advice unless expressly agreed in writing.

6. Compliance, standards and road authority requirements

Where product descriptions refer to Australian Standards, road authority requirements, certifications, approvals or common temporary traffic management use, those references are provided to help customers understand the product’s intended application and specification context.

Buying a product from UAGS does not automatically make a worksite, vehicle, traffic management setup, electrical installation, project or traffic control arrangement compliant.

Customers must confirm suitability for their specific use, including any applicable traffic management plan, traffic guidance scheme, project specification, vehicle fitout requirements, electrical requirements, workplace procedures, road authority requirements or legal obligations.

Where wording such as “prepared with reference to”, “designed for use in”, “commonly used in” or similar wording is used, it should not be read as a guarantee that the product is suitable for every project, authority, installation or site condition.

7. Orders

When you place an order, you are making an offer to purchase the products in that order. An order is not accepted until we confirm acceptance, process payment or begin fulfilling the order.

We may accept, decline, cancel or limit an order where reasonably necessary, including where a product is unavailable, incorrectly priced, incorrectly described, affected by a website error, subject to supplier changes, unsuitable for delivery, or otherwise unable to be supplied.

If we cancel an order after payment has been taken, we will arrange a refund for the cancelled item or order, unless another solution is agreed with you.

8. Pricing, GST and payment

Prices on the UAGS website are shown in Australian dollars and exclude GST unless expressly stated otherwise.

GST will be added at checkout where applicable and shown before the order is finalised.

Shipping, handling, bulky freight, pallet freight, special delivery charges, payment surcharges or other additional charges may apply and will be shown or confirmed before the order is finalised where practical.

UAGS primarily supplies trade, business and commercial customers, and ex-GST pricing is used as part of our standard B2B pricing structure.

Prices, promotions, discounts and availability may change without notice. The price charged will be the price confirmed at the time your order is accepted, unless there has been an obvious error.

You agree to provide accurate payment information and confirm that you are authorised to use the payment method provided.

9. Quotes, trade pricing and wholesale orders

Any quote, trade price or wholesale offer issued by UAGS is valid only for the period stated on the quote or offer. If no period is stated, pricing may be withdrawn or changed at any time before the order is accepted.

Quoted pricing may be subject to stock availability, supplier pricing, freight costs, currency changes, minimum order quantities, account terms or project-specific requirements.

Trade account, wholesale, bulk order or purchase order terms may be subject to separate written terms agreed between UAGS and the customer.

10. Order changes and cancellations

Please review your order carefully before submitting it. Once an order has been accepted, packed, dispatched, ordered from a supplier, manufactured, customised or allocated to a job, we may not be able to change or cancel it.

Custom products, made-to-order products, special-order products, printed signs, modified products and products ordered specifically for a customer may not be cancellable once production, procurement or order processing has started.

Any cancellation approval is at UAGS’ discretion unless required under Australian Consumer Law.

11. Shipping and delivery

Shipping and delivery are subject to our Shipping Policy. Delivery times are estimates only and may be affected by courier delays, supplier delays, stock availability, bulky freight handling, regional delivery limitations, weather, public holidays or events outside our control.

UAGS is not responsible for delivery delays caused by freight carriers, incorrect delivery information supplied by the customer, access issues at the delivery location or events outside our reasonable control.

For bulky, heavy, palletised or oversized goods, the customer may need to ensure suitable unloading access, forklift access, business-hours receiving, safe delivery conditions or a suitable delivery contact.

Risk in the goods passes to the customer on delivery, collection, or another point specified in our Shipping Policy or agreed in writing, subject to any rights that cannot be excluded under Australian Consumer Law.

12. Returns, refunds and exchanges

Returns, refunds and exchanges are handled in accordance with our Returns Policy.

UAGS does not offer automatic change-of-mind returns. Return requests must be approved by UAGS before any item is sent back.

Nothing in these Terms of Service or our Returns Policy limits any rights you may have under Australian Consumer Law.

13. Warranty

Warranty terms vary by product, brand and category. Some products are covered by a manufacturer warranty, a UAGS warranty, or both.

Warranty claims may require proof of purchase, photos, inspection, testing, installation details or confirmation that the product was used within its intended application and operating conditions.

Warranty does not cover normal wear and tear, misuse, incorrect installation, incorrect wiring, overloading, modification, accidental damage, unauthorised repair, poor storage, environmental exposure beyond the product’s intended use or use outside manufacturer instructions, except where required under Australian Consumer Law.

Warranty rights apply in addition to your rights under Australian Consumer Law.

14. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under Australian Consumer Law.

15. Intellectual property

All website content, including text, images, product descriptions, graphics, logos, icons, layout, downloads and other material, is owned by or licensed to UAG Services Pty Ltd unless otherwise stated.

You must not copy, reproduce, modify, distribute, republish, scrape, download, store or use our website content for commercial purposes without our prior written permission, except where permitted by law.

The UAGS name, UAG Services name, logos, product content and brand assets must not be used in a misleading, unauthorised or unlawful way.

16. Reviews, comments and submissions

If you submit reviews, comments, photos, feedback, suggestions or other content to UAGS, you confirm that you have the right to provide that content and that it does not infringe the rights of any third party.

You grant UAGS permission to use, display, reproduce, edit and publish that content for website, customer service, marketing, product improvement or business purposes.

We may moderate, edit, reject or remove submitted content at our discretion.

17. Third-party services and links

Our website may include links, apps, payment providers, freight tools, embedded content or other services operated by third parties.

Third-party services are provided by their respective providers and may be subject to their own terms and privacy policies. UAGS is not responsible for third-party websites, systems, content, delays, faults or actions.

18. Maropost

Our online store is powered by Maropost, which provides ecommerce services that allow us to sell products to you.

Any sale or purchase made through this website is made directly between you and UAG Services Pty Ltd. Maropost is not responsible for any product, order, delivery, warranty claim, return, loss, damage or dispute arising from your purchase from UAGS, except to the extent required by law or Maropost's own terms.

19. Privacy and security

Personal information is handled in accordance with our Privacy Policy.

Payments may be processed by Eway, payment providers or other third-party services. Do not send sensitive payment information, card details or bank details by email.

While we take reasonable steps to maintain website security, we do not guarantee that the website will always be uninterrupted, error-free or free from harmful components.

20. Limitation of liability

To the maximum extent permitted by law, UAGS is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of business opportunity, loss of data, project delay, installation cost, removal cost, downtime or similar loss arising from use of the website, product selection, product use, delayed delivery or inability to use a product.

Where liability cannot be excluded under Australian Consumer Law or other applicable law, our liability is limited to the extent permitted by law.

21. Indemnity

You agree to indemnify UAG Services Pty Ltd, its officers, employees, contractors and suppliers against loss, damage, liability, cost or expense arising from your misuse of the website, breach of these Terms of Service, unlawful conduct, infringement of third-party rights, incorrect information supplied by you, or misuse, incorrect installation or unauthorised modification of products, except to the extent caused by UAGS’ negligence, breach of law or failure to comply with non-excludable obligations.

22. Errors, inaccuracies and omissions

We may correct errors, inaccuracies or omissions on the website at any time, including errors relating to product descriptions, specifications, pricing, stock availability, freight charges, promotions, delivery times or images.
